MURCIAN GOVERNMENT REGULATION FOR CHRISTMAS AND NEW YEAR

The BORM, Murcian Official Gazette, published the Decree No. 11/2020 on December 23rd the specific regulation for Murcia, affecting the movement and meeting of persons for the future, and with an specific regime for Christmas and New Year in article 6.

Maximum number of persons per group is established

For clarity, the translation of the Decree will commence with the Christmas and New Year regulations:

Article 6. Specificities for the Christmas period.

Without prejudice to the general measures contained in this Decree, during the Christmas period from 23 December 2020 to 6 January 2021, the following specificities shall apply:

6.1 Notwithstanding the restrictions of movement established in Article 1, and for the period 23 December to 6 January 2020 [sic], inclusive, persons shall be allowed to enter and exit the territory of the Autonomous Community of the Region of Murcia to travel to territories which are the place of habitual residence of their relatives, only for the purpose of enabling family reunification on the indicated days.

6.2. On the nights of 24 and 31 December 2020, the freedom of movement of persons shall be expanded, for the performance of the family meetings referred to in paragraph 6.3, from 23:00 to 01:30 the following day. This enlargement should not be used to enable displacements to different social gatherings.

6.3 During the 24th, 25th and 31st of December 2020 and 1 January 2021, family gatherings will be allowed in public or private spaces, both in enclosed and outdoor premises, for the holding of family meals and dinners, conditioned to family groups consisting  of a maximum of 10 people , unless they are convivial.

It is recommended that no more than two groups of convivial persons participate in these meetings, it is not authorized in these meetings the participation of more than three groups of convivial persons.

In the remaining days of the Christmas period, meetings shall be subject to the general regime for groups, as set out in Article 4.

Family meetings are specially regulated this Christmas and New Year

The regulation that the Decree declares to be applicable from today and beyond January 6 is translated below:

Decree of the President No. 11/2020 of 22 December updating the restriction measures adopted under Royal Decree 926/2020 of 25 October declaring an alarm status to contain the spread of infections caused by SARS-COV-2

Article 1. Limitation of the freedom of movement of people during night hours.

1.1 The limitation of the freedom of movement of persons during night hours is determined during the period from 23:00 to 6:00 hours, under Article 5 of Decree 926/2020 of 25 October declaring the status of alarm to contain the spread of infections caused by SARS-CoV-2.

1.2 Persons may only move through public roads or spaces for the purpose of carrying out the following activities:

(a) Procurement of medicines, medical devices and other basic necessities.

b) Assistance to health centers, services and establishments.

c) Assistance to veterinary care facilities for emergencies.

d) Compliance with labor, professional, business, institutional or legal obligations.

(e) Return to the place of habitual residence after performing some of the activities provided for in this paragraph.

(f) Assistance and care for the elderly, minors, dependents, persons with disabilities or especially vulnerable persons.

g) Because of force majeure or situation of need.

(h) Any other activity of similar nature, duly accredited.

(i) Refueling at petrol stations or service stations, where necessary for the performance of the activities provided for in the preceding paragraphs.

(j) Justified travel to airports, ports, train or bus stations to take away or pick up passengers travelling whose cause is justified under this Decree, provided that they have the status of direct relatives out of consanguinity or affinity until the second degree.

3. In line with the limitation on freedom of movement laid down in this Article, during the hours with restriction of movement and mobility of persons during night hours, all non-essential commercial establishments of any kind shall remain closed to the public, except those referred to in paragraph 2(b), (c) and (i).

Article 2. Limitation of the entry and exit of people in the territorial area of the Region of Murcia.

1. It is restricted the entry and exit of persons to or from the territory of the Autonomous Community of the Region of Murcia, this si agreed under the authority of Article 6.1 of Royal Decree 926/2020 of 25 October declaring the status of alarm to contain the spread of infections caused bySARS-CoV-2, except for those properly justified travels, which occur for one of the following reasons:

(a) Assistance to health centers, services and facilities.

b) Compliance with labor, professional, business, institutional or legal obligations.

c) Attendance at university, teaching and educational centers, including children’s schools.

d) Return to the place of habitual or family residence.

(e) Assistance and care for adults, minors, dependents, persons with disabilities or particularly vulnerable persons.

(f) Displacement to financial and insurance institutions or refueling stations in adjacent territories.

(g) Actions required or urgent to be held in front of  authorities public or judicial, or in front of a notary.

(h) Renewals of permits and official documentation, as well as other non-deferrable administrative procedures.

(i) Conducting non-deferred official examinations or tests.

j) Because of force majeure or situation of need.

(k) Justified travel to airports, ports, train or bus stations to take away or pick up passengers travelling whose cause is justified under this Decree, provided that they have the status of direct relatives out of consanguinity or affinity until the second degree.

l) Any other activity of similar nature, duly accredited.

Article 3. Exclusion of traffic limitation.

Movement in transit through territorial areas where the limitations provided for in this Decree apply shall not be subject to restriction.

Article 4. Limitation of the permanence of groups of people in public and private spaces.

The permanence in public and private spaces, both in enclosed and outdoor premises, is restricted to a maximum of 6 persons, unless they are conviviants and without prejudice to the exceptions established in relation to certain activities and establishments open to the public. In the case of groups in which both convivial and non-convivial persons are included, the maximum number allowed will be 6 people.

Article 5. Limitation on the permanence of people in places of worship.

The limitation of the stay of persons in places of worship is determined, in accordance with the following capacity for meetings, celebrations and religious meetings:

5.1 Ceremonies will not exceed 50% capacity in enclosed spaces (with a maximum of 30 people).

5.2 Places of worship will exceed 50% capacity in enclosed spaces. It is recommended to offer telematics or television services.

5.3 Outdoors without limitations provided that the safety distance can be guaranteed, unless the number of people planned for mass events is exceeded in the Order of 13 December 2020 of the Ministry of Health, which adopts general measures of a temporary nature, to deal with the COVID-19 epidemic in the Region of Murcia , in which case the rules laid down for them shall apply.

Article 6. Specificities for the Christmas period. (NOTE: it is included at the begining of this post)

Article 7. Implementation of the measures taken. Sanctioning regime. Collaboration between Public Administrations

7.1 Citizens shall actively cooperate in the implementation of the measures provided for in this Decree.

7.2 Non-compliance with this Decree or resistance to the orders of the competent authorities may be punished in accordance with the laws, in the terms laid down in Article 10 of Organic Law 4/1981, 1 June, on the states of alarm, exception and siege, as well as the provisions of Decree Law 8/2020 of 16 July establishing the sanctioning regime for non-compliance with the prevention and containment measures applicable in the Region of Murcia to deal with the situation of health crisis caused by COVID-19 and other applicable regulations.

7.3 This Decree shall be transferred to the Government Delegation and the Municipalities shall be informed for the purpose of seeking their cooperation and collaboration through law en bodies and forces for the control and implementation of the measures taken.

Article 8. Resource regime.

Against this Decree, an administrative action may be brought within two months of its publication in the Official Gazette of the Region of Murcia before the Administrative Chamber of the Supreme Court, in accordance with the provisions of Article 12 of Law 29/1989 of 13 July of the Administrative Jurisdiction.

Article 9. Effects.

This decree shall take effect on the day of its publication in the Official Gazette of the Region of Murcia and shall remain effective until the end of the alarm status, with the exception of Article 6, the validity of which shall end on 6 January 2021.

Notwithstanding  the foregoing, the content of this decree may, where appropriate, be amended, made more flexible or left without effect depending on the evolution of the regional epidemiological situation.
